Court orders Marhanets municipal company to share data on salary arrears with NGO Prykhyst
The Dnipro District Administrative Court upheld NGO Prykhyst's claim against the municipal company “Water Supply and Sewerage Production Office”, subordinate to the Marhanets City Council, and declared their refusal to provide public information unlawful, according to the unified register of court rulings.
Prykhyst requested whether the company has any salary arrears, the amount of the unpaid wages, the reasons for delayes and the payment schedule for the past three months. In January 2025, the municipal company refused to disclose the information, claiming that the query did not articulate the subject clearly enough.
The court concluded that the query was written properly, contained specific requirements, and concerned public information that the company possessed. The court declared the company's refusal unlawful and ordered it to provide all the requested information.
Moreover, the court ruled to collect UAH 3,028 of court fees from the company's budget in favor of the NGO Prykhyst.
The ruling can be appealed to the Third Administrative Court of Appeal within 30 days.
Prykhyst chief editor Anna Tseluyko told Institute of Mass Information representative Valentyna Troyan that she was investigating the activities of many Marhanets officials.
“And people, our subscribers, often ask us themselves to cover this or that topic. This was the case with the wages. We sent a query to the water supply company with a list of questions, received another non-reply and sued. The court granted our claim. They have not filed an appeal. We are preparing a letter to the bailiff service so that they, as the court ruled, order them to answer our questions,” said Anna Tseluyko.
She added that the writ of execution (a document confirming a court ruling's entry into force and granting the right to enforce it. – Ed.) was signed on June 25.
